Eight-year case vs Edu Rama drags on in court

08/05/2010 - EIGHT years after charges were filed, the pre-trial conference on the physical injuries case against Councilor Edu Rama continues to languish in the courts.
Rama didn’t show up druring the pre-trial of the case yesterday.

But his lawyer, former councilor Gerardo Carillo said Rama didn’t have to attend since his presence was not stipulated by the court yet.

Carillo convened with Judge Rosabella Tormis of the Municipal Trial Court in Cities (MTCC) Branch 4 to re-schedule the pre-trial of the case.

Initial presentation of the evidence by the prosecution was scheduled on Sept. 21 and will resume on Oct. 18.

Rama said in a phone interview that he was advised by Carillo not to attend the pre-trial conference.

Rama, Cebu City Mayor Michael Rama's nephew, was one of those accused of mauling Carlo Camaya and Michael Tan Quezon at a convenience store in barangay Lahug, Cebu City last May 2002.

Other respondents in the case were Jimmy Dimaunahan, Andre Ursal, and Jason Narcinco.

The Cebu City Prosecutors' Office had dropped Rama as a respondent from the case, saying he did not inflict harm on the complainants.

But Judge Rosabella Mondragon-Tormis of the Municipal Trial Court in Cities disagreed with the findings of the fiscals and included Rama as one of the respondents in the case.

Before issuing the arrest warrant, Tormis said judges must not rely solely on the report or resolution of the fiscal but must also evaluate the report and the supporting documents.

Both parties underwent settlement proceedings as part of regular procedure
