03/06/2010 - An American national was charged in court yesterday for allegedly sexually abusing two minor girls almost three years ago while two Pakistanis were accused of raping their 16-year old househelp.
Larry M. Johannsen, 48, married, of Texas, USA and residing at Talamban, Cebu City was charged with violating the Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act.
A bail of P200,000 was recommended for Johannsen’s temporary liberty.
Under RA 7610, children, whether male or female, who for money, profit, or any other consideration or due to the coercion or influence of any adult, syndicate or group, indulge in sexual intercourse or lascivious conduct, are deemed to be children exploited in prostitution and other sexual abuse.
The victims filed their complaint against the suspect on Dec. 3, 2008 at the Women and Children's Protection Desk/ Family, Juvenile and Gender Sensitivity at the Cebu City Police Office, Camp Sotero Cabahug in Cebu City.
In their joint complaint filed with the City Prosecutor's office, the two minor victims said they came to know Johannsen in 2007 through a common text mate, one of the victim's sister.
On Sept. 16, 2007, the victims agreed to meet with the accused at a mall in Lapu-Lapu City. The suspect invited them for drinks at Banilad where they drank tequila and beer.
By evening, the two girls had become drunk and checked in with the foreigner at a hotel in Lahug, Cebu City.
According to the victims, Johannsen told them to take a shower. They later joined the suspect in the bedroom.
Johannsen allegedly tried to convince the two girls to have sex with him and promised to pay each P1,000.
The victims said they were surprised and refused the suspect’s offer. But because they were already very drunk, the suspect succeeded in having sexual intercourse with them.
The victims said they did not report the incident immediately since they felt ashamed and didn’t want to be subjected to public ridicule.
Johansen, however, denied raping the girls, saying he was in Lapu-Lapu at that time and could not possibly have done the act.
But the prosecutor's office rejected his alibi since Lapu-Lapu City was just an hour away from Lahug, where the incident happened.
Also yesterday, two Pakistanis were sued for allegedly raping their househelper.
A complaint for two counts of rape was filed against Ahmael Ullah, 19, and his cousin Muhammad Nabi Gul Nabi, 31, for violating RA 7610 or the Anti-child Abuse Act before the Cebu Provincial Prosecutors' Office yesterday.
The suspects were arrested on Wednesday by the Carcar City police inside a rented apartment in sitio Masigbit, barangay Liburon, Carcar City.
Ullah, 19 and Nabi, 31, underwent inquest proceedings before Cebu Provincial Assistant Prosecutors Ferdinand Collantes.
The two suspects signed a waiver of detention which would allow them to avail of a preliminary investigation and submit their counter-affidavits.Collantes gave them two days to submit their counter-affidavits.
In her sworn statement, Jasmin (not her real name), 16, said she was raped by the two twice inside their rented apartment.
On March 1, the victim said she was sleeping inside the room when Ullah knocked on the door at around 10 p.m. Jasmin said Ullah wanted to get something inside the room.
When she went back to bed, Ullah suddenly approached and kissed her, saying “good night.”
Jasmin said she slapped Ullah but the suspect allegedly pulled down her shorts and forcibly had sex with her. Ullah later went out of the room. But Jasmin said Nabi later entered her room and likewise raped her.
The next day, Jasmin said she just finished taking a bath around 9 p.m. when Ullah suddenly entered her room and raped her. After Ullah, she said Nabi also did the same to her.
The following day, the victim accompanied by her mother went to the Carcar Police Station to report the incidents.
The police then arrested the suspects inside their rented apartment.
The victim was brought to the Vicente Sotto Memorial Medical Center for medical examination which showed “definite evidence of sexual abuse or sexual contact.”
